General Terms of Service

1. Overview

These Terms of Service (“Terms”) govern all products and services provided by Netcom (“we”, “us”, “our”) to the customer (“you”, “your”).
By purchasing, registering, or using any service from us, you agree to these Terms.

2. Service Provision

  • We will provide hosting, domain, email, DNS, or related services in accordance with the plan or package you have selected.

  • Services will commence upon receipt of payment and continue for the agreed billing period.

  • We reserve the right to modify, suspend, or discontinue any service at our discretion, with reasonable notice where possible.

3. Customer Responsibilities

  • You are responsible for maintaining accurate contact and billing information in your account.

  • You must ensure all passwords and login credentials are kept secure and not shared with unauthorised persons.

  • You are responsible for the content, security, and legality of any material uploaded, hosted, or transmitted through our systems.

  • You must maintain adequate backups of your data. Although we take regular system backups, we cannot guarantee restoration in all circumstances.

4. Payments & Billing

  • All services are billed in advance according to your chosen billing cycle.

  • Failure to pay invoices by the due date may result in suspension or termination of services.

  • Reactivation of suspended services may incur an administrative fee.

  • All prices are listed in GBP and include VAT where applicable.

5. Service Availability

  • We aim to maintain high service uptime and reliability.

  • Occasional maintenance windows or emergency updates may occur, during which services may be temporarily unavailable.

  • We are not liable for service interruptions caused by events outside our reasonable control, including network failures, DDoS attacks, or third-party outages.

6. Support

  • Support is provided in accordance with your selected support plan.

  • Requests for assistance outside your plan’s allowance may be billed at our standard hourly rate.

  • We may provide remote assistance via secure, encrypted VNC sessions with your explicit consent.

7. Data Protection & Privacy

  • We handle all personal data in compliance with the UK GDPR and Data Protection Act 2018.

  • We will not access or disclose customer data except where required to deliver services or comply with legal obligations.

8. Termination

  • Either party may terminate a service at the end of the current billing period by giving at least 14 days’ notice.

  • We may suspend or terminate services immediately in the event of non-payment, abuse, or violation of our Acceptable Use Policy.

  • Upon termination, all related data and configurations may be permanently deleted.

9. Liability

  • We shall not be held liable for any indirect, consequential, or incidental damages, including loss of data, revenue, or business opportunities.

  • Our total liability for any claim arising from our services shall not exceed the total amount paid by you for the affected service in the previous 12 months.

10. Amendments

  • We reserve the right to update or amend these Terms at any time.

  • Continued use of our services after any update constitutes acceptance of the revised Terms.
